When the application is accepted, our system will randomly generate a password and send it to individual members by both e-mail and mail. Members are strongly recommended to change their assigned passwords upon receival. The password must be made up of 6-8 characters which can be any letter among 'a' to 'z', 'A' to 'Z' and '0' to '9'. “AUTHORIZED USE” of FCDFood Composition
Database (“FCD”) is developed and operated by The Chinese University of
Hong
Kong(“University”)to provide reference nutrition data to facilitate members of the food industry to prepare nutrition labels of their food
products. It is intended as a general reference only to supplement the existing
knowledge of professionals in the food industry.
Qualifications for Users and
Conditions of UseThe members’ section
of FCD is only
available to users who have gone through the registration process (“FCD Members”). The information contained in the members’ section of this Site is directed at, and is intended for distribution to, and use
by FCD Members.It is not intended for
distribution to, or use by, any other person.
RegistrationYou will log into the members’ section of FCD with the username (“Username”) and
password (“Password”) assigned specifically to you after registration. You are responsible for providing us accurate
and complete registration information and advising us
promptly of any change.University,
however, reserves the right to terminate or suspend your access to FCD without notice at its own discretion.
Login ID and PasswordYou shall be responsible for the
confidentiality and use of your Username and Password.If you suspect that someone may have
obtained access to your Password or made any unauthorized use of your Password,
you undertake to notify University as soon as possible.University may refuse your access to FCD until University is satisfied that security has been re-established.
Intellectual Property RightsThe content, data, organization,
graphics, design, compilation, translation, digital conversion and other
matters related to FCD are owned by University or its
licensors and are protected under all applicable copyrights, database rights,
trade marks, patent and other proprietary (including but not limited to
intellectual property) rights which may exist now or
in the future.Any copying,
redistribution, use or publication by you of any such matters or any part of FCD, except as allowed by the section
entitled “Limited Right to Use” below, is strictly prohibited. You do not acquire ownership rights to any
content, data, document or other materials viewed through FCD. The posting of data, information or materials on FCD does not constitute a waiver of any right in such data, information and materials.
Limited Right to UseThe viewing, printing or
downloading of any content, data, graphic, form or document from FCD grants you only a limited, non-exclusive license for the AUTHORIZED
USEsolely by you and not for
republication, distribution, assignment, sublicense, sale, preparation of
derivative works or other use. No part of any content, data, graphic, form or
document may be reproduced in any form or incorporated into any information
retrieval system or database, electronic or mechanical, other than for your
internal use (but not for resale or redistribution).
No Responsibility for Errors or
InaccuraciesUniversity does not warrant that FCD will be uninterrupted or error free.University is
not responsible for errors or other inaccuracies in the content, data or

Users’ Own ResponsibilityThe food
composition data
provided by FCD is an average of nutrients in a limited number of particular samples of food product/ingredient,
determined at a particular time. The nutrition composition of
food products/ingredients may vary substantially between different batches and different sources.Given such limitations, the data by FCD are necessarily approximate in
nature rather than exactly reflective of the food
products’/ingredients’ average nutrition composition.
University makes FCD
available on the understanding that you exercise your own skill, care and
judgment with respect to its use. Before relying on the data provided by FCD, you should carefully evaluate the
completeness, accuracy and relevance of such data for your purposes, and should
obtain appropriate expert advice relevant to your particular circumstances.
Indemnification You
hereby waive and agree to indemnify, defend, and hold harmless University, its
respective trustees, directors, employees, agents, subcontractors, and students
(“Indemnitees”) from any liability, damage, loss, or
expense (including reasonable attorneys' fees and expenses of litigation)
incurred by or imposed upon the Indemnitees or any
one of them in connection with any claims, suits, actions, demands, or
judgments arising out of or connected with this Agreement, except to the extent
that such liability is due to the negligence of University.
ModificationsUniversity may, in its sole
discretion and without prior notice to you, modify the content, data,
functionality, presentation or information of FCD.University will not be responsible for
any effects such modification may have on you or your use of FCD.
AmendmentUniversity reserves the right from
time to time and without notice to make changes to this Agreement as University
deems fit.Notice of any change
will be posted on the ‘Terms of Use’ page of FCD and you
are responsible for regularly reviewing these terms and conditions.Continued use of FCD after notice of
change shall constitute your agreement to be bound by such new terms.
Links to Other Web SitesFCD contains links to other Web
sites. University is not responsible for the content, accuracy or opinions expressed in such Web sites, and such Web sites are not
investigated, monitored or checked for accuracy or completeness by University.
Inclusion of any linked Web site on FCD does not imply approval or endorsement
of the linked Web site by University. If you decide to leave the Site and
access these third-party sites, you do so at your own risk.
Collection of User InformationBroadly speaking, University uses
information supplied by FCD Members for purposes of administering
University’s activities, providing service and making available other products
and services to its users and prospective users.
Occasionally, University may also use the information it collects to notify you
about important changes to FCD, new services and special offers University
thinks you will find valuable.
University
uses web site browser software tools such as cookies and web server logs to gather
information about its users' browsing activities in
order to constantly improve FCD and better serve its users.
This information assists University to design and arrange its web pages in the most user-friendly manner and to continually improve
FCD to better meet the needs of the food industry and users and prospective
users.
By
using FCD, you consent to University’s collection and use of your information
as described in this Agreement.
Restriction on Use of NameNo right or licences are granted
by University to you expressly or by implication to use the name or any trademark, service mark, trade name or symbol of The Chinese University of
Hong Kong or any of its employees in any advertising or
promotional materials, public relations activities or other materials or activities or in connection with your
products or business without University's prior written consent.
Governing Law and JurisdictionThis Agreement shall be governed
by and construed in accordance with the laws of the Hong Kong SAR, excluding
conflict-of-law principles that would cause the application of the laws of any
other jurisdiction.You hereby
submit to the non-exclusive jurisdiction of the courts of Hong Kong SAR.
庚部 Section G – 超連結協議 Hyperlink Agreement
Upon
registration as a member of Food Composition Database(“Database”), The Chinese University of Hong Kong (“University”) will grant you a non-exclusive, royalty free,
non-transferable license to incorporate a hyperlink (“Link”) from
your Internet web site (“Your Site”) to the Database at [http://foodcompdb.fns.cuhk.edu.hk/]
(“FCD Site”), using the logo of the Database (“FCD Logo”) as depicted in
Schedule 1, subject to the terms and conditions set out below.By establishing the Link you agree to
these terms and conditions.
1.University hereby grants to you and you hereby accept a non-exclusive,
non-transferable, revocable right to use and display the FCD Logo solely in
connection with establishing the Link on Your Site.
2.You acknowledge that all
rights, including intellectual property rights, in the FCD Logo, the link button, FCD Site and
Database not expressly granted to you in this Agreement
shall remain vested in University.
3.You agree to create and
maintain the Link in Your Site by using the FCD Logo as the hyperlink icon in a
prominent position on the home page of Your Site, but not in such a way that it is displayed more prominently than the
name/logo of your company.The Link shall point to http://foodcompdb.fns.cuhk.edu.hk/ and not to any other pages within University’s web site or other web sites.
4.Apart from using the FCD
Logo as the hyperlink icon for the Link, you undertake not to use the name or
any trade mark, service mark, trade name or any symbol of University, Food
Research Centre, Food
Composition Database, The Hong Kong
Jockey Clubor TheHong Kong Jockey Club Charities Trust, Food
and Health Bureau, Food and Environmental Hygiene Department, The Centre for Food Safety or any of
their departments or employees (collectively “the FCD Funding
Organization and Supporting Government Departments”) on
Your Site or elsewhere in any advertisements, packaging, marketing activities,
public relations activities or other activities or as part of your corporate
name or firm or trade name or for any other purpose.
5.You agree not to display
the linked web pages from the FCD Site within a frame of Your Site or modify or alter the content or manner of display of the FCD
Site.
6.You agree that the
position, appearance or presentation of the FCD Logo on Your Site, whether on
its own or in conjunction with other graphic image or literary text, must not
create any impression that you or any of your products or services are
connected or associated with, or endorsed or sponsored by University or the FCD Funding Organization and Supporting Government Departments.
7.You agree not to disparage
University, the FCD Funding Organization and Supporting Government
Departments or their products or services.
8.The FCD Logo may only be
used as a hyperlink icon on Your Site for the Link, and not for any other
purposes including but not limited to advertising, marketing, promotion or
publicity for Your Site, your company or your products or services.
9.All representations of the FCD Logo on Your Site shall be exact copies
of the logo depicted in Schedule 1. You may not alter or change the FCD Logo in
any way, including size, perspective, colour,
proportions, or animate it.
10.Your Site may not contain materials that are illegal,
deceptive, unethical,distasteful or offensive.
11.University shall have the right to terminate this Agreement and the licence hereunder,
in its sole discretion, at
any time without liability or
obligation to you of any kind, with or without cause, and may make amendment to this Agreement without
prior notice.In the event that this Agreement is terminated, you shall remove the FCD
Logo, including the Link, and all references to University or Database, within
twenty-four (24) hours of written request by University.
12.University does not warrant
that the use of the FCD Logo, the Link, the FCD Site and Database will be uninterrupted or error free.You expressly agree that the use of the FCD Logo, the
Link, the FCD Site and Database is at your sole risk. University is not responsible for errors or other inaccuracies in the content,
data or information provided in the FCD Site and Database.University provides
the FCD Logo, the Link, the FCD Site and Database “AS IS” and “AS AVAILABLE” without any warranty of any kind.TO THE FULLEST EXTENT LEGALLY
PERMISSIBLE, UNIVERSITY DISCLAIMS ANY WARRANTIES, EXPRESS OR IMPLIED, REGARDING
ANY MATTER WHATSOEVER RELATING TO OR REFERENCED BY DATABASE, THE FCD SITE, FCD LOGO AND THE LINK, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY,
FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT.IN NO
EVENTWILLUNIVERSITY
BE LIABLE FOR ANY INDIRECT,
SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OF OR
INABILITY TO USE DATABASE AND THE CONTENT,
DATA OR INFORMATION CONTAINED IN FCD SITE.
13.You hereby waive and agree to indemnify, defend, and hold harmless
University, its respective trustees, directors, employees, agents,
subcontractors, and students (“Indemnitees”) from any
liability, damage, loss, or expense (including reasonable attorneys' fees and
expenses of litigation) incurred by or imposed upon the Indemnitees or any one of them in connection with any claims, suits, actions, demands, or judgments
arising from your breach of this Agreement or your hyperlink to the FCD Site.
14.This Agreement shall be
governed by and construed in accordance with the laws of the Hong Kong SAR,
excluding conflict-of-law principles that would cause the application of the
laws of any other jurisdiction.You
hereby submit to the non-exclusive jurisdiction of the courts of Hong Kong SAR.
